In Disabled Education, Ruth Colker digs deep beneath the\u003cbr\u003e\nIDEA’s surface and reveals that the IDEA contains flaws that were evident at\u003cbr\u003e\nthe time of its enactment that limit its effectiveness for poor and minority\u003cbr\u003e\nchildren.\u003cbr\u003e\nBoth an\u003cbr\u003e\nexpert in disability law and the mother of a child with a hearing impairment,\u003cbr\u003e\nColker learned first-hand of the Act’s limitations when she embarked on a legal\u003cbr\u003e\nbattle to persuade her son’s school to accommodate his impairment. Colker was\u003cbr\u003e\nable to devote the considerable resources of a middle-class lawyer to her\u003cbr\u003e\nstruggle and ultimately won, but she knew that the IDEA would not have\u003cbr\u003e\nbenefitted her son without her time-consuming and costly legal intervention.\u003cbr\u003e\nHer experience led her to investigate other cases, which confirmed her\u003cbr\u003e\nsuspicions that the IDEA best serves those with the resources to advocate\u003cbr\u003e\nstrongly for their children. The IDEA\u003cbr\u003e\nalso works only as well as the rest of the system does: struggling schools that\u003cbr\u003e\nserve primarily poor students of color rarely have the funds to provide\u003cbr\u003e\nappropriate special education and related services to their students with\u003cbr\u003e\ndisabilities.
